(“Genco”, “nós”) trata dados pessoais no contexto do Genkinho, nosso assistente/bot que opera via WhatsApp e integra-se aos nossos sistemas internos para consulta de informações de clientes. Esta política está publicada no site da Genco, mas refere-se especificamente ao serviço Genkinho.

2. Scope and Definitions

Serviço: o Genkinho (bot/assistente no WhatsApp) e funcionalidades associadas.
Titular: a pessoa a quem os dados pessoais se referem (“você”).
Operadores (subprocessadores): terceiros que tratam dados pessoais em nosso nome para viabilizar o Serviço.
Sistemas Integrados: portais e ERPs corporativos necessários para atender às suas solicitações via Genkinho.

3. What data we collect

We collect only the data necessary to provide the Service, including:

• Identificação e contato: número de telefone usado no WhatsApp; quando você informa, nome e e-mail para autenticação e contato.
• Mensagens e uso: metadados das interações (datas/horas, status de entrega/erro, IDs técnicos), conteúdo mínimo das mensagens necessário para executar suas solicitações e registro de comandos/opções escolhidas.
• Técnicos: endereço IP, identificadores de dispositivo/cliente, registros de aplicação (logs de erro e desempenho) e dados de diagnóstico.
• Integrações: identificadores de cliente/empresa e dados estritamente necessários para consultar suas informações nos Sistemas Integrados (por exemplo, dados de GNC/CTC), sempre conforme sua solicitação no Genkinho.

4. Purposes and Legal Bases (LGPD)

We process your personal data for the purposes below, with the respective legal bases of Law 13.709/2018 (LGPD - General Data Protection Law):

• To provide the Service and fulfill your requests via Genkinho, including authentication and return of requested information (performance of a contract or preliminary procedures, art. 7, V).
• Security, fraud and abuse prevention, monitoring, and auditing of use, including for account and environment protection (legitimate interest, art. 7, IX, and/or compliance with a legal/regulatory obligation).
• Support, maintenance, and continuous improvement of Genkinho (legitimate interest in enhancing the service and correcting errors).
• Operational communications about the functioning of the Service (performance of a contract / legitimate interest).
• Marketing only with your specific consent (opt-in), when applicable (art. 7, I). Genkinho does not send offers without consent.
• Compliance with legal obligations and authority requests (art. 7, II).

5. Cookies and similar technologies

Genkinho operates via WhatsApp and does not use its own cookies. If you access linked web pages (e.g., to open documents), such pages may use cookies according to their specific policies.

6. Data Sharing

We do not sell your personal data. We do not share your data with partners for marketing purposes, and we do not make your information visible to other users.

We may share data only in the situations below, with adequate contractual and technical safeguards:

• Operators/suppliers that process data on our behalf (e.g., WhatsApp/Meta API, hosting and transactional email providers, monitoring, and analytics).
• Genco affiliates, requiring compliance with this Policy.

• Legal requirements and protection: to comply with laws and orders from authorities and protect rights, safety, and prevent illicit acts.

7. International Transfers

Your data may be processed and/or stored outside of Brazil (e.g., by cloud infrastructure or WhatsApp platform services). In such cases, we adopt adequate mechanisms (contractual clauses, technical controls, and risk assessments) to ensure a level of protection compatible with the LGPD.

8. Retention

We retain data only for the time necessary for the described purposes and to comply with legal/regulatory requirements. Technical logs and metadata may have shorter retention periods, unless required for security, auditing, or defense of rights.

9. Your Rights (LGPD)

You may exercise, when applicable, the following rights:

• confirmation of the existence of data processing and access to the data;
• correction of incomplete, inaccurate, or outdated data;

10. Security

Genkinho is not intended for children. For minor data subjects, when applicable, we will process data only with the specific and highlighted consent of at least one of the guardians, as per the LGPD.

The Genco website may contain links to third-party websites. We recommend reading the privacy policies of those websites. We are not responsible for their practices.
